The SARFAESI Act aims at speedy recovery of defaulting loans and to reduce the mounting levels of Non-performing Assets of banks and financial institutions. The Provisions of the Act enables the banks to recover loan from borrower/ guarantor/ mortgagor without much intervention of the Court by simply issuing notice under SARFAESI Act and to take possession of mortgaged property. It further enables bank to sell property of borrower in auction to recover its loan.

Similarly, it has also become imperative for the unsuspecting Borrower/ Guarantor/ Mortgagor to put up their case strongly in writing right from beginning of the recovery proceedings by replying to the notices of Bank/ Financial Institution on time. In case of being aggrieved, the Borrower/ Guarantor/ Mortgagor may file case against the financial institution before the Debt Recovery Tribunals and Debt Recovery Appellate Tribunals constituted under the provision of Act itself.

Further, with recent development in the field of insolvency and bankruptcy resolution brought about by the new Insolvency and Bankruptcy Code 2016 and further proposed amendments, the code as compared to other recovery law, has become extremely attractive as an alternative form of time-bound recovery resolution.
